These Terms of Service ("Terms") govern your use of Attune ("Attune", "we", "our", or "the app"). By downloading, installing, subscribing to, or using Attune, you agree to these Terms. If you do not agree, do not use the app.

Apple EULA

These Terms apply to the use of Attune. For subscriptions purchased through the Apple App Store, Apple's standard End User License Agreement (EULA) also applies: apple.com/legal/internet-services/itunes/dev/stdeula

About Attune

Attune provides binaural beats, monaural beats, isochronic tones, ambient soundscapes, focus audio, and related wellness features for personal use. The app is intended for general wellness, relaxation, focus, meditation, and sleep support.

Use of the App

You may use Attune for your personal, non-commercial purposes only.

You may not:

• copy, redistribute, resell, sublicense, or commercially exploit any audio, visuals, text, artwork, or other content included in the app;
• record, extract, export, or redistribute app-generated audio or included audio content as standalone content;
• reverse engineer, decompile, disassemble, modify, or attempt to access the source code of the app, except where permitted by applicable law;
• use the app for unlawful, harmful, or abusive purposes;
• interfere with the operation, security, or performance of the app.

Health and Safety Disclaimer

Attune is a wellness tool and is not a medical device. The binaural beats, monaural beats, isochronic tones, ambient soundscapes, and other audio features provided by Attune are intended for general wellness purposes only. They are not intended to diagnose, treat, cure, or prevent any disease, disorder, or medical condition.

Attune does not provide medical advice. You should consult a qualified healthcare professional before using the app if you:

• have epilepsy, seizures, or a history of seizures;
• have a heart condition, wear a pacemaker, or use other implanted medical devices;
• are pregnant;
• have a neurological, psychiatric, or medical condition that may be affected by audio stimulation;
• experience dizziness, discomfort, anxiety, headaches, nausea, or any other adverse effects while using the app.

Stop using the app immediately if you experience discomfort or adverse effects.

Do not use Attune while driving, operating machinery, cycling, walking in traffic, or performing any activity that requires your full attention.

Listen at a comfortable volume. Prolonged use of headphones or speakers at high volume may cause hearing damage.

Subscriptions and Purchases

Attune may offer optional paid subscriptions or purchases, including Attune Pro, which unlock additional features, content, or functionality.

Purchases and subscriptions are processed by Apple through the App Store. Payment will be charged to your Apple ID account at confirmation of purchase.

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period.

Your Apple ID account may be charged for renewal within 24 hours before the end of the current subscription period.

You can manage or cancel your subscription in your Apple ID account settings.

Refunds, cancellations, and billing issues are handled by Apple according to Apple's App Store policies.

Any unused portion of a free trial period, if offered, may be forfeited when you purchase a subscription, where permitted by Apple's policies.

We may change subscription prices, features, or availability from time to time. Any price changes will be handled according to Apple's App Store rules.

Intellectual Property

All content and materials in Attune, including audio, soundscapes, visuals, artwork, user interface elements, text, branding, and code, are owned by Jakob Rundgren or licensed to us and are protected by copyright, trademark, and other intellectual property laws.

These Terms do not grant you any ownership rights in the app or its content. You receive only a limited, personal, non-exclusive, non-transferable, revocable license to use the app in accordance with these Terms and applicable App Store terms.

App Availability and Changes

We may update, modify, suspend, or discontinue parts of Attune at any time. Features, presets, audio content, visuals, and subscription offerings may change over time.

We do not guarantee that the app will always be available, uninterrupted, error-free, or compatible with all devices or operating system versions.

Privacy

Your use of Attune is also governed by our Privacy Policy, available at https://attunebinaural.com/privacy.

Apple Standard EULA

Your use of Attune is also subject to the Apple Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

Third-Party Services

Attune may rely on third-party services, including Apple for App Store distribution, payments, and subscription management; RevenueCat for subscription status and entitlement management; Mixpanel for anonymous usage analytics (when you have opted in); and Supabase for hosting app assets. Your use of these services may also be subject to their respective terms and policies.

Disclaimer of Warranties

Attune is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

Limitation of Liability

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, goodwill, or other intangible losses arising from or related to your use of or inability to use Attune.

Nothing in these Terms limits liability where it would be unlawful to do so.

Termination

We may suspend or terminate your access to the app if you violate these Terms or use the app in a way that may harm the app, other users, or third parties.

You may stop using the app at any time. Deleting the app does not automatically cancel an active subscription; subscriptions must be managed through your Apple ID account settings.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted with an updated revision date. If we make material changes, we will take reasonable steps to notify users where appropriate.

Governing Law

These Terms are governed by the laws of Sweden, except where mandatory consumer protection laws in your country of residence provide otherwise.
